Welcome to Gongster's Paradise! The terms “we”, “us” and “our” refer to Gongster's Paradise. Gongster's Paradise operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Gongster's Paradise is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy [LINK]. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colours or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

We do not warrant that the appearance or quality of any products or services purchased by you will meet your subjective expectations or be exactly the same as depicted or rendered in our online stores.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

Nothing in this Section affects any legal rights you may have as a consumer in relation to products that are faulty or not as described.

SECTION 3 – ORDERS

When you place an order, you are making an offer to buy products from us. We will let you know if we accept your order. A contract is formed between you and Gongster’s Paradise when we send you an order confirmation email.

We must receive and successfully process your payment before we accept your order. Please review your order carefully before submitting it. Once we have accepted your order, we may not be able to change or cancel it before dispatch, although you may still have a legal right to cancel as described below.

If we cannot accept your order, make a change to your order, or have to cancel it (for example because a product is out of stock, because of an unexpected limit on our resources, or because we have identified an error in the price or description of the product), we will contact you using the email address, billing address and/or phone number you provided and will refund any amounts you have paid for products we do not supply.

Your purchases are subject to return, refund or exchange in accordance with our Refund Policy [LINK] and your statutory rights.

If you are a consumer in the UK or EU and you buy goods online, you may have a legal right to cancel your order within 14 days after the day you (or someone you nominate) receives the goods, subject to certain exceptions (for example, for personalised items, sealed items that are not suitable for return for health protection or hygiene reasons once unsealed, or digital content once download or streaming has begun with your consent). Our Refund Policy explains how to exercise this right, what you are entitled to and who pays the costs of returning items.

Nothing in these Terms of Service or in our Refund Policy affects your statutory rights.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honoured by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

SECTION 5 – SHIPPING AND DELIVERY

We will provide you with an estimated delivery timeframe during checkout. Delivery times are estimates only and are not guaranteed, but we will deliver the products without undue delay and, unless we agree otherwise with you, within 30 days after the day on which we accept your order.

If our supply of the products is delayed by an event outside our reasonable control, we will contact you as soon as reasonably possible to let you know and will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received.

If no one is available at your address to take delivery and the products cannot be posted through your letterbox, the carrier may leave you a note with information on how to rearrange delivery or collect the products from a local depot. If, after a failed delivery to you, you do not re-arrange delivery or collect the products, we may contact you for further instructions and may charge you for storage and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection, we may end the contract and refund any money you have paid for products we have not supplied, but we may deduct or charge you reasonable costs we incur as a result (for example, additional storage or delivery costs).

If you are a consumer in the UK or EU and we arrange delivery of the products, the products will be at our risk until they are delivered to you or to a person you nominate to receive them. If you choose to use your own carrier that we have not offered or recommended, risk in the products passes to you when we deliver the products to that carrier.

Title to the products will pass to you on the later of: (a) delivery of the products; and (b) receipt by us in full of all sums due in respect of the products, including delivery charges.

Customs and import duties may be payable for deliveries outside the UK, and these are your responsibility unless we expressly state otherwise during checkout.

Nothing in this Section affects your legal rights if we fail to deliver the products in accordance with our contract with you.

SECTION 6 – INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Gongster's Paradise, its affiliates or licensors and are protected by UK, EU, US and other applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Gongster's Paradise, Shopify or any third party. Unauthorized use of the Services may be a violation of intellectual property laws. All rights not expressly granted herein are reserved by Gongster's Paradise.

Gongster's Paradise’s names, logos, product and service names, designs, and slogans are trademarks of Gongster's Paradise or its affiliates or licensors. You must not use such trademarks without the prior written permission of Gongster's Paradise. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third-party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Gongster's Paradise is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Gongster's Paradise. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Gongster's Paradise, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Gongster's Paradise.

SECTION 10 – PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here [LINK], and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or that violates any party’s intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third party.

SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

This Section does not affect your statutory rights and does not permit us to avoid our obligations where you have already entered into a contract with us on the basis of clear and accurate information.

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly:

(i) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm Gongster’s Paradise, Shopify or users of the Services, or expose them to liability.

In addition, you agree not to:

(a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services;
(b) reproduce, duplicate, copy, sell, resell or exploit any portion of the Services;
(c) collect or track the personal information of others;
(d) spam, phish, pharm, pretext, spider, crawl, or scrape; or

We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 14 – TERMINATION

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

Termination does not affect any orders you have already placed or your statutory rights.

The following Sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available solely for general information purposes. While we use reasonable efforts to keep the information on the Services accurate and up to date, we do not guarantee that the content on the Services is free from errors or omissions. Any reliance you place on such information is at your own discretion.

Except as expressly stated in these Terms or required by law, the Services are provided on an “as is” and “as available” basis and we do not make any specific promises about the Services or their availability. In particular, we do not warrant that your use of the Services will be uninterrupted, timely, secure or error-free, or that the Services will be free from viruses or other harmful components.

However, nothing in these Terms is intended to exclude or limit any legal rights you may have as a consumer which cannot be excluded or limited by law. If you are a consumer in the UK or EU, the products we supply must by law be as described, fit for purpose and of satisfactory quality. To the extent permitted by applicable law, we exclude all warranties, representations and conditions (whether express or implied) in respect of the Services, other than those expressly set out in these Terms.

SECTION 16 – LIMITATION OF LIABILITY

Nothing in these Terms of Service excludes or limits our liability for:

death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation; or
any other liability that cannot be excluded or limited under applicable law.

If you are a consumer:

We are responsible for loss or damage you suffer that is a foreseeable result of our breaching these Terms or our failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
We are not responsible for loss or damage that is not foreseeable, for losses that were not caused by any breach on our part, or for losses that are caused by events outside our reasonable control.
We only supply the products for domestic and private use. If you use the products for any commercial, business or re-sale purpose, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If you are a business customer:

Subject to the first paragraph of this Section, our total aggregate liability to you arising out of or in connection with the Services or any products supplied under these Terms (whether in contract, tort (including negligence), breach of statutory duty or otherwise) shall be limited to the higher of (a) the total amount paid by you to us for the products and Services giving rise to the claim in the 12 months preceding the event giving rise to the liability, and (b) £100.
We shall not be liable to you for any loss of profit, loss of revenue, loss of savings, loss of goodwill, loss of data, or for any indirect or consequential loss or damage.

Nothing in this Section affects your statutory rights.

SECTION 17 – INDEMNIFICATION

If you are a business customer, you agree to indemnify, defend and hold harmless Gongster’s Paradise, Shopify, and our and their affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from and against any losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or in connection with: (1) your material breach of these Terms of Service; (2) your infringement of any third party’s intellectual property rights in connection with your use of the Services; or (3) your unlawful or fraudulent use of the Services.

If you are a consumer, this indemnity only applies to the extent that your intentional or grossly negligent acts cause us loss (for example, where you knowingly submit unlawful content that infringes a third party’s rights). It does not require you to indemnify us for normal, lawful use of the Services or for matters that are our fault.

We will notify you of any claim for which we seek indemnity as soon as reasonably practicable and will give you reasonable information and assistance in defending such claim. We will not agree to any settlement that imposes any non-monetary obligations on you without your prior consent (not to be unreasonably withheld or delayed).

SECTION 18 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Services constitute the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 20 – ASSIGNMENT

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void.

We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you. Any such transfer or assignment will not affect your statutory rights.

SECTION 21 – GOVERNING LAW

If you are a consumer and you live in the UK or in a country in the EU, you will benefit from any mandatory provisions of the law of your country of residence. Nothing in these Terms of Service, including this Section, affects your rights as a consumer to rely on such mandatory provisions.

These Terms of Service and any separate agreements whereby we provide you Services are governed by the law of the jurisdiction where Gongster’s Paradise is headquartered, but you and we may bring legal proceedings in the courts of your country of residence or in the courts of that jurisdiction.

If you are a business customer, these Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of the jurisdiction where Gongster’s Paradise is headquartered, and you and we irrevocably submit to the exclusive jurisdiction of the courts of that jurisdiction.
